REGISTRATION OF TOURIST ESTABLISHMENTS
Information about categorization of tourist establishments
The submission of documents for categorization of tourist establishments, payment of categorization fees and tourist fees takes place in Room No 1C (Cash Desk), Floor 3 in the building of Tourist Service Municipal Enterprise, at 44 Oborishte St., Sofia. All administrative activities stipulated in the Law on Tourism, the Ordinance for Rating of Collective Tourist Accommodation Establishments, Supplementary Tourist Accommodations, Mass-catering and Entertainment Establishments, and the Regulation on the organization of the Unified System of Tourist Information (ESTI) are carried out here.
At the reception desk of the Registration, Reporting and Control Department information about tourist establishments/sites is filed, verified, accepted, registered, stored and archived:
- A comprehensive check of the documents for categorization is made;
- The documents are accepted, processed and registrered;
- Receipts are issued for the amounts received, tourist fees or category fees;
- The accepted documents are kept.
The person who performs or will perform hotel- or restaurant-keeping activities, or his representative submits an Application for rating or for change of the category of the tourist establishment, accompanied by the documents, as follows:
Documents required for Rating of Mass-catering and Entertainment Establishments:
- Current certificate for registration of the person/entity in the Trade Register – the original, a notarized copy or copies of documents showing that the entity has the right to carry on business as per the provisions of another law or the legislation of another state – a EU Member State, or of another country – party to the European Economic Area Agreement.
- Evidence that the person is not in filed for liquidation or bankruptcy – original certificate or a notarized copy;
- Proof of ownership – a copy;
- Lease or other contract evidencing that there are conditions for the person to carry out the tourist activity in the establishment – a copy;
- Document certifying that the property has been put into operation as intended – a copy;
- Document certifying the professional and linguistic qualifications of the manager of the tourist establishment – a copy;
- Current category symbol – a copy;
- Proof of payment of an initial 50% fee of the total fee depending on number of seats – a copy;
- Notarized power of attorney – the original, if the application filed by an attorney;
- Current draft for deployment of the seats in the open area – applies to seasonal establishments;
- Forms for rating, as per the sample blankform (No 1, No 2, No 3 and No 4).
Necessary documents for Rating of Collective Tourist Accommodation Establishments and Supplementary Tourist Accommodations:
- Current certificate for registration of the person/entity in the Trade Register – the original, a notarized copy or copies of documents showing that the entity has the right to carry on business as per the provisions of another law or the legislation of another state – a EU Member State, or of another country – party to the European Economic Area Agreement.
- Evidence that the person is not in filed for liquidation or bankruptcy – original certificate or a notarized copy;
- Proof of ownership – a copy;
- Lease or other contract evidencing that there are conditions for the person to carry out the tourist activity in the establishment – a copy;
- Document certifying that the property has been put into operation as intended – a copy (does not apply for rating of individual rooms or houses);
- Document certifying the professional and linguistic qualifications of the manager of the tourist establishment – a copy;
- Current category symbol – a copy;
- Proof of payment of an initial 50% fee of the total fee depending on number of beds/rooms – a copy;
- Notarized power of attorney – the original, if the application filed by an attorney;
- Forms for rating, as per the sample blankform (No 5, No 6, No 7 and No 8); for individual rooms (No 6, No 7, No 8 and No 9).
Documents required for the initiation of a Change of Circumstances Procedure (change of lessee/owner) of the tourist establishment:
When there is a change of the person/entity operating the establishment, within 30 days from the change the new person/entity should submit an Application to the relevant rating authority for entering the changed circumstances in the National Tourist Register:
- Current certificate for registration of the person/entity in the Trade Register – the original, a notarized copy or copies of documents showing that the entity has the right to carry on business as per the provisions of another law or the legislation of another state – a EU Member State, or of another country – party to the European Economic Area Agreement.
- Evidence that the person is not in filed for liquidation or bankruptcy – original certificate or a notarized copy;
- Proof of ownership – when ownership is changed – a copy;
- Lease or other contract evidencing that there are conditions for the person to carry out the tourist activity in the establishment – a copy;
- Unified Identifcation Number – a copy;
- Document certifying the professional and linguistic qualifications of the manager of the tourist establishment – a copy;
- Current category symbol – a copy;
- Proof of payment of 150 Leva fee – a copy;
- Notarized power of attorney – the original, if the application filed by an attorney;
- Forms, as per the sample blankform (No 10 and No 4 or No 8).
When applying for rating with an incomplete set of documents, the applicant should submit the missing documents within 14 days. If not e missing documents are not sumbitted, the applying person is notified in writing at the address specified in the registration. In the case of a complete Application for rating set of documents, within one week a provisional certificate is issued for an open rating procedure, valid for 2 months. Within this period, an expert working group from the Enterprise visits the tourist establishment and prepares an Observation Protocol with a proposal for rating or refusal to rate the tourist establishment. Permanent Certificate of Category is issued before the expiry of the provisional certificate.
Termination of category
The category of tourist establishments is terminated under the following circumstances:
- At the request of the owner of the tourist establishment;
- When the type of the tourist establishment is changed;
- When reconstruction or expansion of the tourist establishment is carried out;
- In the event of for repeated violation of the requirements of Article 46, Para.1, 3 and 4 of the Law on Tourism;
- If within a 6-month period the applicant for rating does not report at the Enterprise to receive the category symbol;
- If the obligations under Article 49, Para 1, 3 and 4 of the Law on Tourism are not fulfilled.
Establishments not subjected to rating
Rating under the Ordinance for Rating of Mass-catering and Entertainment Establishments is not required for the following types of establishments: mass-catering and entertainment establishments, educational and medical institutions, agencies and enterprises, where the catering establishments are intended for use only by members of their staff, as well as cafeterias, kiosks, caravans, bakery shops with capacity of 12 seats.
